Consumer-Facing Website Reminders

CMS has confirmed a renewed focus on all websites, especially those that market to consumers with the intent to collect contact information to be used or distributed as a lead. CMS has found ‘numerous and troubling violations on 3rd party websites’.
When developing or updating your website, pay special attention to the following:
Violations
- Needs assessments or inappropriate request for health status (e.g. weight; tobacco use)
- Identifying a Medicare Supplement Insurance plan as a Medicare Advantage plan
- Using unsubstantiated absolute superlatives (e.g. the best; the biggest)
- Absence of required disclaimers
Websites must:
- Be clear and easy to navigate
- Maintain a separate and distinct section on the website for Medicare information
- Be submitted to a carrier for CMS approval, the status of the website is noted as “pending” until CMS has provided approval/disapproval
