Third Party Marketing and Enrollment Website Approval

The Centers for Medicare and Medicaid Services (“CMS”) has issued additional requirement to Plan/ and Part D sponsors. Effective immediately any “third party marketing or enrollment website that includes Medicare lead generation” must be submitted to any Medicare carrier that you hold an appointment and certification.

All third party websites that provide contracted agents or agencies with leads must now go through a formal review and approval process. The carrier must then submit to CMS for review and approval.

Why is this happening? CMS conducted an audit and found several marketing violations on third party websites. These violations include, but are not limited to:

  • Inappropriate requests for health status information
  • Misleading information, such as identifyinh a Medicare Supplement plan as a Medicare Advantage plan
  • Use of unsubstantiated absolute suerlatives
  • Missing required disclaimers

Submitting a website for approval

Once you have submitted your website for approval, it will go through a formal review process with the carrier(s). If the website is compliant, it will be sent directly to CMS for filing.

Please allow 7 to 10 business days for CMS to review and approve. If the website is found not to be compliant, you will receive further notification of non-compliance and the necessary changes required, if you plan to proceed with the use of the website for lead generation.
