MS has confirmed there is a renewed focus on websites that market to consumers with the intent to collect contact information to be used or distributed as a lead. Please read and share the content and pay close attention to these points of interest:
CMS has found “numerous and troubling violations on 3rd party websites”.
Violations include:
- Needs assessments or inappropriate request for health status (e.g. weight; tobacco use)
- Identifying Medicare Supplement Insurance plan as a Medicare Advantage plan.
- Using unsubstantiated absolute superlatives (e.g. the best; the biggest)
- Absence of required disclaimers.
Websites that request consumer contact information for leads must comply with Chapter 3 Medicare Marketing Guidelines.
CMS expects health plans and related entities to monitor all websites and to take appropriate and immediate action if the website is found to be non-compliant.
Please review your website and make sure it complies with CMS’ Chapter 3 Medicare Marketing Guidelines.
